Terms & Conditions
1. Who we are and what Makero does
Makero ("Makero", "we", "us") is operated by Studio Maré. Makero gives tradespeople and small workshops a public page, a quote request form, an assistant that answers visitor questions on that page, and a dashboard to manage the requests that come in. Makero also sends some emails to your clients on your behalf (see section 6). By creating an account or using the service you agree to these terms.
2. Your account
Makero is meant for businesses and self-employed professionals. You confirm that the details you give us are correct and that you use Makero for your business. You are responsible for keeping your login safe and for everything done through your account.
3. Plans and payment
The free plan includes 3 job requests a month and 3 of your own questions on the form. Professional costs €29 a month or €290 a year and adds unlimited requests and questions, more room for the assistant, and no Makero logo on your page. We never charge a fee per request or per job.
Payments are processed by Paddle.com Market Limited as our reseller and merchant of record. Paddle handles checkout, invoices, sales tax and refunds; its terms apply to the payment itself. You can cancel at any time from your billing settings. Your plan stays active until the end of the period you paid for. If we change our prices, we tell you at least 30 days before the change applies to you. Refunds are described in our refund policy.
4. Your page and your content
Everything you add, such as photos, texts, prices, your logo and your questions, stays yours. You give us permission to store, show and process it as far as needed to run Makero. You confirm that you have the right to use what you upload, and that what your page says about your work, prices and availability is correct and lawful.
5. Job requests and your clients
Makero passes requests from your clients to you. What happens next, such as visits, quotes, prices, agreements and the work itself, is between you and your client. We are not a party to those agreements and we do not guarantee that you receive requests or win jobs. You decide which questions your form asks; only ask for information you actually need for the job.
6. Automatic emails and the assistant
When a client sends a request, Makero emails them a confirmation on your behalf. If you switch on reminders, Makeroalso sends one reminder when a request has had the status "Quote sent" for 4 days. These emails say that they are automatic and are sent on your behalf, and replies go to your email address. Every automatic email is shown on the request in your dashboard.
The assistant on your page is an AI system. It tells visitors it is an AI assistant, answers from the information you give us, never gives binding prices and never plans appointments. Like any AI it can make mistakes. Check what it answers and keep the information on your page up to date. You stay responsible for the prices and promises you make to your clients.
7. Processing your clients' personal data
For the personal data of your clients and visitors that reaches you through Makero, such as names, contact details, addresses, photos and answers, you are the controller and we are your processor under the GDPR. This section is our processing agreement with you. We:
- process this data only to provide Makero to you and on your documented instructions;
- make sure everyone who works with the data is bound to confidentiality;
- take appropriate technical and organisational security measures;
- only use the sub-processors listed in our privacy notice, and tell you before we add or replace one so you can object;
- help you respond to requests from people who want to use their privacy rights;
- tell you without undue delay when we become aware of a personal data breach that affects your data;
- delete the data when you delete it or close your account, apart from short backup cycles;
- give you the information you need to show that these obligations are met.
You are responsible for having a lawful basis to collect your clients' data and for informing your clients about it, for example with a link to your own privacy statement.
8. Acceptable use
Do not use Makero for unlawful activity, spam, misleading offers, content that infringes the rights of others, or attempts to get around limits or security. We may remove content or suspend accounts that break these rules or put the service or other users at risk.
9. Changes and availability
We keep improving Makero, so features may change. We aim to keep the service available at all times but cannot guarantee it is never interrupted. When a change takes away something important you pay for, we tell you in advance.
10. Ending the agreement
You can stop at any time by deleting your account. We may suspend or end accounts for non-payment, fraud, or a serious or repeated breach of these terms. After your account ends we delete your data as described in our privacy notice.
11. Liability
We are not liable for indirect damage, such as lost jobs, lost income or damage caused by information you or the assistant gave a client. Our total liability is limited to the amount you paid us in the 12 months before the event that caused the damage. These limits do not apply to damage caused by our intent or gross negligence.
12. Changes to these terms
We may update these terms. For important changes we tell you by email or in the dashboard at least 30 days before they apply. If you do not agree, you can stop before the new terms apply.
13. Applicable law
Dutch law applies to these terms. Disputes go to the competent court in the Netherlands.
